Copyrightguidelines

The Dunedin College of Education and Otago Polytechnic have signed contracts for licences with Copyright Licensing Limited, Print Media Copyright Agency and Screenrights which have important implications for the Library’s Reserve Collection as well as copying in general.

CLL Guidelines

The licence provided by Copyright Licensing Ltd enables copying from hard copy originals beyond the limits set by the Copyright Act 1994:

  • Up to 10% or one chapter of a work, whichever is larger;
  • Up to 15 pages of all or part of a single work in a collection of works even if the works are published separately;
  • One or part of one article from a periodical publication, or additional articles from the same periodical publication if they are on the same subject;
  • The source of each extract/copy must be identified with full citation details;
  • Copying must be true to the typographical format of the work copied;
  • Instructors may distribute hard copy compilations of extracts from books and journals to their students and seek to recover copying costs;
  • Instructors may distribute electronic copies of extracts from books and journals to their students by means of a password protected Intranet (i.e. a Blackboard course page);
  • CLL’s Copyright warning notice must be included prominently on any compilation:

This material may be used for the institution’s educational purposes. It includes extracts of copyright works copied under copyright licences. You may not copy or distribute any part of this material to any other person. Where this material is provided to you in electronic format you may only print from it for your own use. You may not make a further copy for any other purpose. Failure to comply with the terms of this warning may expose you to legal action for copyright infringement and / or disciplinary action by the institution.

CLL Restrictions

The licence does not permit copying of the following, which must be copied in accordance with the Act or with permission from the copyright owner:

  • Works stipulating that they may not be copied under a copyright licence;
  • Works downloaded from the Internet;
  • Printed music (including the words); loose maps and charts;
  • New Zealand newspapers (from October 2003);
  • Photographs and/or illustrations published separately from a textual work;
  • Privately owned work issued for tuition purposes and limited to fee payers;
  • Theses, dissertations and student papers.

We suggest that instructors examine all copied material that they wish to have on Reserve, and evaluate whether it can legally be made available on Blackboard.   If material is considered to be essential reading for a course, the expectation is that each student either has access to it via Blackboard, or they are provided with their own hard copy.  Copies of such material kept in the Reserve Collection is "Read only", and should only be considered as a back up.

LIANZA Copyright Act Guidelines

PMCA (Print Media Copyright Agency) Guidelines

The licence provided by PMCA enables copying of articles appearing in most most New Zealand print media publications (PDF 47 KB) for academic, general staff and students for educational purposes, and for general staff for internal management purposes.

  • Photocopies made both ad hoc and systematically;
  • Faxing articles;
  • Digitally scanning articles for circulation via email or other secure electronic means (e.g., Blackboard);
  • Distributing articles on CD/DVD;
  • Up to five articles from any single edition of a publication each day;
  • Multiple copies of a single article for use in course material;
  • Distributing a copy or copies to overseas students enrolled in the licensee’s institution as part of distance learning course material;
  • Instructors may seek to recover copying costs;
  • "Produced under licence from the PMCA" must be included prominently on any compilation.
PMCA Restrictions

The licence does not permit the following, which must be done in accordance with the Act or with permission from the copyright owner:

  • Copying taking place outside New Zealand;
  • Copying of advertisements;
  • Digital copying of publications marked with ND;
  • Conversion to searchable text.

Screenrights Guidelines

Screenrights was established under provisions in the New Zealand Copyright Act, to provide schools and tertiary institutions with access to an important educational resource while ensuring that the rights holders who make the programmes educators want to use, are paid for their work.  Screenrights is a non-profit company that distributes all money it collects to the copyright owners in the programmes you tape, after deducting only its administrative overheads.
The licence provided by Screenrights enables copying from television and radio programmes (any station; pay or free to air) for example documentaries, movies, current affairs and news for use in teaching. There are no limits to either the amount of a programme that may be copied, or on the number of copies made.

Electronic Databases

Full text electronic databases subscribed to by the Library are subject to separate licence agreements. Each agreement is different, with some allowing printing of articles from the databases for inclusion in print course-packs, and/or making electronic copies of articles for inclusion in electronic course-packs, and/or linking from electronic reading lists to the electronic full-text articles in the databases; other licence agreements do not allow any or all of these.  Staff wishing to copy electronic full-text articles for print course-packs, or to provide access for students to articles included in full-text databases, should consult the Library as to whether the specific database licence agreements permit this.
